Terms of Service & Acceptable Use Policy
These Terms of Service govern your use of the LUXMNZ platform, including our inventory vault, multi-currency invoicing, carrier logistics integrations, and email broadcasting tools.

1. Workspace Ownership and Access
Each subscription grants access to a dedicated business workspace. The subscribing dealership retains exclusive legal ownership of all uploaded timepiece records, customer contact details, serial numbers, and financial transaction archives.
Boutique administrators are responsible for managing internal team credentials, enforcing two-factor authentication where applicable, and assigning appropriate role permissions to showroom staff.
2. Acceptable Use Policy (AUP) & Anti-Spam Terms
LUXMNZ operates a shared, high-reputation multi-tenant email delivery infrastructure. To protect system-wide deliverability, ISP relationships, and compliance with anti-spam laws, all subscribers must strictly adhere to the following sending rules:
Subscribers are expressly forbidden from uploading, importing, or emailing contacts acquired via purchased lists, rented lists, scraping tools, directory harvesting, co-registration, or third-party lead brokers. Every email address in your workspace must belong to a client who interacted directly with your dealership.
Email broadcasts (Showroom plan) may only be dispatched to recipients with whom your dealership has an existing, verifiable business relationship (such as past timepiece purchasers, consignors, or active collectors) or who have given verifiable express consent under Canada's Anti-Spam Legislation (CASL), the US CAN-SPAM Act, and the EU General Data Protection Regulation (GDPR).
To safeguard our shared network reputation, subscribers must maintain healthy sending statistics:
- Bounce Rate: Must remain below 5.0% across any broadcast sequence.
- Spam Complaint Rate: Must remain strictly below 0.1% (maximum 1 complaint per 1,000 sent emails).
All commercial broadcasts sent through LUXMNZ automatically embed the sender's physical postal coordinates and an instantaneous one-click unsubscribe mechanism. Subscribers shall not attempt to remove, obscure, or circumvent these compliance footers.
3. Invoicing, Currencies, and Financial Disclaimers
LUXMNZ facilitates invoice generation, sequential numbering (`YYMM-XXXX`), and wire transfer balance tracking across 10 currencies. Dealerships remain solely responsible for ensuring tax compliance (including VAT, sales tax, and second-hand margin scheme rules) in their respective tax jurisdictions.
Direct bank wire receipts must be verified with your financial institution before releasing physical custody of high-value horological parcels. LUXMNZ does not process wire funds and is not a financial intermediary.
4. Multi-Tenant Isolation, Service Availability & Backups
LUXMNZ operates high-availability cloud infrastructure with automated continuous database backups and strict tenant isolation. Dealerships can export their complete vault inventories, customer records, and invoice ledgers to spreadsheet format at any time with a single click.
Neither LUXMNZ nor other tenant organizations have access to your private inventory acquisition costs or internal profit margins.
5. Governing Law & Jurisdiction
These Terms of Service and any operational disputes arising out of or related to the LUXMNZ platform shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
6. Email Communications & Acceptable Use
LUXMNZ sends transactional emails on behalf of subscribing dealerships, including invoices, payment reminders, shipping notices, and account messages. Organization administrators may also send messages to members of their own organization. Users agree to send email only to individuals who have an established commercial relationship with the dealership or are registered members of its organization. The transmission of unsolicited bulk email, purchased lists, or unauthorized messages is strictly prohibited.
